E-SERVICE PROVISION REGULATIONS

CONCEPTS
- GDPR shall stand for Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
- Visitor shall mean any natural person visiting the Website. Types of visitors shall be as follow:
- User shall be any Visitor using the Website without registration;
- Registered User shall be any Visitor using the Website with registration;
- Professional User shall be any Visitor entitled to issue prescriptions or sell medicinal products;
- Registered Professional User shall be any Visitor using the Website with registration entitled to issue prescriptions or sell medicinal products.
- Norameda shall mean Norameda Private Limited Company, address: Meistru Str. 8A, Vilnius c., address for correspondence: Gyneju Str. 16, Vilnius m., Company reg. No. 140744584, VAT payer No. LT407445811.
- Services shall mean electronical services provided through the Website by Norameda.
- Privacy and Cookie Policy shall mean the rules applicable to personal data management and cookie usage, published in the Website and annexed to the Regulations.
- HCSL Number shall stand for the number of the licence issued to a health care specialist (medical practitioner, obstetrics practitioner, nursing practitioner, odontology practitioner, oral care practitioner, public health care specialist, personal health care specialist, supplementary and alternative health care specialist following applicable laws and other legal acts of the Republic of Lithuania.
- E-service Provision Agreement shall mean the agreement on provision of the Services to the extent intended in the Regulations.
- Website shall mean the Internet platform at https://www.norameda.com, where Norameda is providing Services to Visitors.
- PPL Number shall stand for the number of the pharmaceutical practice licence issued following the Order No. V-1012 ‘On Approval of Pharmaceutical Practice Licensing Regulations’ by Health Minister of the Republic of Lithuania as of 28 November, 2006.
- Regulations shall mean the regulations on provision of e-services through the Website by Norameda hereto including all annexes thereof.
GENERAL PROVISIONS
- The Regulations hereto shall set the terms, conditions and principles of using the Website as well as the terms and conditions of provision of the Services to Visitors.
- Norameda shall be manager of the Website. Norameda shall provide free Services to Visitors of the Website following provisions of the Regulations and the Privacy and Cookie Policy.
- Use of the Website shall mean your acceptance of the Regulations.
- The Regulations shall be published on the Website. Norameda shall be entitled to modify the Regulations without prior notice. Your rejection of the Regulations or modifications to the Regulations might mean you would not be able to use the Services.
RIGHTS AND OBLIGATIONS OF SERVICE USERS
- Visitors shall be entitled to:
- Use Services at no cost;
- Lodge applications and claims in the manner prescribed by the Regulations;
- Exercise their rights intended in the Privacy and Cookie Policy;
- Stop using the Website any time.
- Visitors shall have the following obligations:
- Use Services following legal acts of the Republic of Lithuania, GDPR, the Regulations, the Privacy and Cookie Policy and good morality and ethics standards;
- Provide only true, correct and legally managed data and information;
- Retain from any action that might possibly violate rights or legal interests of Norameda, other Visitors or third parties.
SERVICE PROVISION RULES
- Norameda shall provide the Services following the Regulations and the Privacy and Cookie Policy, ensure timely management of applications and claims and take any action required to ensure uninterrupted access to the Services.
- Norameda shall reserve the right to turn the Website off fully or partially due to force majeure circumstances, technical failure or illegal intrusions by Visitors or third parties.
- Norameda Website shall offer Services to Visitors to the extent depending on the type of Visitors (see Section 1.2. above).
- The following Services shall be provided to Visitors of the Website:
- Registration and account management;
- Scientific, informative or educational messages related to Norameda itself or activities of Norameda published in the Notices or News sections;
- Permission to view content of the Website;
- Ordering and revocation of subscription for the newsletter;
- Using the contact form (query);
- Using the contact form (query) for subjects interested in partnership with Norameda;
- Using the contact form (query) for media;
- Registration of the suspected adverse reactions reported by the persons other than health care specialists;
- Staff search and employment.
- Registered Professional User shall be able to use all of the Services listed in Section 4.4. and the following ones:
- Registration of the suspected adverse reactions reported by health care specialists;
- Possibility to get advertising, scientific, informative or other educational content, including information related to Norameda itself or activities of Norameda and meant for the persons entitled to issue prescriptions or sell medicinal products exclusively.
- Registration (reporting) of the suspected adverse reactions (SAR) shall be done following Order No. V-185 ‘On Approval of Health Care Specialist or Pharmacist Report of the Suspected Adverse Reaction (SAR) Submission Policy Description, Health Care Specialist or Pharmacist Report of the Suspected Adverse reaction (SAR) Form and Patient Report of the Suspected Adverse reaction (SAR) Form’ by Health Minister of the Republic of Lithuania as of 20 February, 2013. Registering the suspected adverse reaction, information must be given in the form approved by Health Minister and include the following: first name, surname, address and speciality of the reporting person, initials, age, and sex of the patient, name of the drug suspected to have caused the adverse reaction, description of the suspected adverse reaction, classification of the reaction as having serious sequelae or mild sequelae and outcome of the reaction.
PROVISION OF SERVICES TO REGISTERED VISITORS (USERS)
- Visitors willing to be registered on the Website must give the following personal data:
- First name and surname;
- E-mail address.
- Visitors (Registered Professional Users after registration) willing to be registered on the Website must also indicate their HCSL or PPL number in addition to Visitor registration data. The HCSL or PPL number entered shall be checked by the Website algorithm for automatic verification of data entered in the HCSL or PPL number field.
- Services to Professional Users shall be provided on the basis of HCSL or PPL number required to be entered each time they use the Services.
- By registering themselves on the Website Visitors confirm they have read the Regulations and the Privacy and Cookie Policy and accepted provisions thereof.
- A Visitor shall become either Registered User or Registered Professional User after registration and shall be able to use Services of the Website.
- Creation of Registered professional User account shall require approval by Norameda Website administrator.
- Norameda shall reserve the right to limit usage of the Website by Registered User or Registered Professional User (block user account immediately) in the cases such Registered User or Registered Professional User violates the Regulations, especially in the cases of but not limited to the following violations:
- Entering false registration data on the Website;
- Violation of rights of third persons by using the Website;
- Actions that may be treated as contradictory to the principles of good morality and ethics, incompliant to the principles of applicable legal acts and/or general Internet usage, contradictory to the goals of Norameda business or harmful to good name and business reputation of Norameda.
- Registered Users and Registered Professional Users deprived of the right to use the Website shall not be able to register on the Website without prior consent by Norameda.
TECHNICAL AND OTHER PROVISIONS OF SERVICE
- In order to get the most of the functionality of the Website your software should comply with the following technical conditions:
- Windows, Android, iOS, MacOS or Ubuntu operating system;
- Latest version of Mozilla Firefox, Safari, Google Chrome, Opera or Microsoft Edge browser.
- Failure to comply with the technical provisions listed in Section 6.1 above does not mean the Visitor will not be able to use the Services; however, a part of the Services might work unduly or not work at all. Failure to provide certain individual services caused by the failure to comply with the technical provisions listed in Section 6.1 above shall not be treated as failure to fulfil or unduly fulfilment of E-services Provision Agreement by Norameda.
AGREEMENT MAKING AND TERMINATION PROVISIONS
- The Service Provision Agreement shall be considered made at the moment of beginning to use the Services and shall expire automatically as soon as the Services are finished to be used.
- Registered Users and Registered Professional Users shall be entitled to terminate the E-services Provision Agreement in the case of changes to the Regulations. In such case the Agreement shall be terminated on the last day before the updated Regulations become effective. Norameda must be noted about termination of the E-services Provision Agreement in written or by e-mail to info@norameda.com.
- Registered Users, Registered Professional Users and Norameda shall be entitled to terminate the E-services Provision Agreement with prior notice to the opposite party 7 days before termination.
PROTECTION OF INTELLECTUAL PROPERTY
- All information published on the Website including its informative content and audio-visual and other creations shall belong to Norameda.
- Property rights to all information and material provided to Visitors by Norameda during a visit on the Website shall belong to Norameda. Download of any material from the Website or reception by e-mail shall mean that Norameda has granted a non-exclusive licence to use the material for non-commercial purposes and personally to the Visitor.
- In the case the Visitor is willing to use the material received from Norameda for commercial purposes (presentations, training course, conference, etc.) he/she shall be obliged to get written consent by Norameda.
CLAIM LODGING POLICY
- Visitors shall be entitled to lodge applications, comments and claims regarding the Services provided. All information and claims regarding fulfilment of the Agreement shall be sent by e-mail to info@norameda.com.
- A claim must include data enabling to identify and contact the claiming Visitor: first name, surname; e-mail address or address for correspondence; claim subject, circumstances and date of the incident; request for taking actions addressing Norameda (e. g., investigate illegal actions, provide information, provide data, etc.).
- Norameda shall process the claim within 30 days from reception and inform the Visitor on its decision by e-mail or registered mail. If data or information provided in the claim by the Visitor requires supplementation, Norameda shall request the claiming Visitor to supplement the claim. Claim processing period shall be extended in the amount of time taken to give additional explanations by the Visitor.
- Norameda shall not process the claims and applications ant not react to the queries unrelated to the Website and the Services and in the case such applications or claims are caused by the failure to comply with the Regulations hereto.
MEDICAL AND PHARMACEUTICAL CONTENT ON THE WEBSITE
- Medical and pharmaceutical content, including the content related to medicinal products, shall be provided for information purposes exclusively. It cannot be treated as professional advice, consultation or diagnosis. Such information cannot serve for a piece of advice by doctor or other professional health care service.
- Information leaflet of any medicinal product must be read before beginning to take or starting treatment with the medicinal product. Visitors following information from the Website exclusively act on their own risk.
FINAL PROVISIONS
- The Regulations shall become effective on the day they are published on the Website.
- The Privacy and Cookie Policy shall be Annex No. 1 hereto.
- The Regulations, including the Privacy and Cookie Policy, can be changed:
- Due to changes to applicable legal acts affecting content of the Regulations and services provided on the Website;
- To the extent of changes in relation to Services provided on the Website;
- Due to changes in technical requirements.
- Norameda shall inform Registered Users and Registered Professional Users about changes in the regulations by e-mail minimum 7 days before such changes become effective. Notices on changes in the Regulations shall also be published on the Home Page of the Website and shall be visible even to non-registered users. Further use of the Website shall mean acceptance of the new version of the Regulations. In the case a Registered User or Registered Professional User disagrees with the new version of the Regulations, he/she shall be able to terminate the Agreement in the way described in Section 7.3 above.
- Laws of the Republic of Lithuania shall apply to the E-services Provision Agreement made by and between a Visitor and Norameda the subject of which is the Services provided by Norameda through the Website with the terms and conditions defined in the Regulations hereto.
- Any dispute in relation to the Services provided by Norameda through the Website shall be resolved through negotiation; in the case of failure to resolve a dispute peacefully within 20 days, it shall be passed to be resolved by a competent court of Vilnius city.
